IMPORTANT NOTE: Our separate Notice of Privacy Practices governs how your protected health information ("PHI") is used and disclosed in connection with clinical services, in accordance with the Health Insurance Portability and Accountability Act ("HIPAA"). This Privacy Policy addresses information practices more broadly, including non-PHI data collected through our website and platform.

1. Introduction

This Privacy Policy describes how Neshiva Wellness LLC ("Neshiva," "we," "us," or "our") collects, uses, and discloses information about you through our website, patient portal, and related services (the "Platform"), and through email, text, and other communications with you. This Privacy Policy is incorporated into our Terms of Use. By using the Platform, you acknowledge you have read and agree to this Privacy Policy. If you disagree with any part of it, please do not use the Platform or provide any personal information.

This Privacy Policy does not apply to information collected by third parties, including any site linked to or from our Platform. Those sites may have their own privacy practices.

2. Information We Collect

Information you give us, such as:

  • Name, address, email, phone number, and account details;
  • Health-related information you share with us or our affiliated clinicians (history, conditions, medications, and anything exchanged in messages, forms, or calls);
  • Billing and payment details (processed through our third-party payment processor — we do not store full card numbers);
  • Information you submit in testimonials, surveys, or communications with support.

Information collected automatically, such as:

  • IP address, device and browser type, operating system;
  • Pages visited, time spent, referring URLs, and general usage patterns;
  • Information collected via cookies and similar tracking technologies.

Information from other sources, such as our affiliated clinical partners, pharmacies, analytics providers, or other service providers who share information with us to help deliver your care or operate the Platform.

3. Cookies and Tracking

We use cookies and similar technologies to operate the Platform, remember your preferences, and understand how the Platform is used. You can set your browser to refuse cookies, though some parts of the Platform may not function properly as a result. Neshiva does not currently recognize or respond to Global Privacy Control (GPC) signals or Do Not Track signals.

4. Third-Party Payment and Service Tools

We use a third-party payment processor to handle billing; a cookie may be placed to help detect and prevent fraud during checkout. We may also use analytics or performance-monitoring tools to understand how the Platform is used and to identify and fix errors. Review the privacy policies of these providers directly for details on their own data practices.

5. How We Use Your Information

We use the information we collect to:

  • Provide, maintain, and improve the Platform and connect you with clinical services;
  • Process payments and administer your account;
  • Communicate with you about your care, appointments, orders, or account (by phone, email, text, or in-platform message);
  • Respond to your inquiries and provide support;
  • Detect and prevent fraud and protect the security of the Platform;
  • Create de-identified, aggregate data for analytics or service improvement;
  • Comply with applicable law and enforce our Terms of Use.

6. SMS/Text Messaging

If you opt in to receive text messages from Neshiva (appointment reminders, refill notices, care-related updates, or promotional messages), message frequency may vary and message/data rates may apply. Reply STOP to opt out at any time, or email support@neshiva.com ; you'll receive one confirmation and no further messages. Reply HELP or contact us at support@neshiva.com for assistance.

We do not share your SMS opt-in status or phone number with third parties for their own marketing purposes. We may share this information only with vendors who help us deliver the messages themselves (e.g., our messaging platform or carrier).

7. How We Disclose Your Information

We may disclose information as follows:

  • To our affiliated clinical partners and their clinicians, so they can review your information and provide care;
  • To pharmacies or labs involved in fulfilling something a clinician has ordered for you;
  • To service providers who support our technology, security, payment processing, or communications infrastructure;
  • To comply with a legal obligation, protect our rights or the safety of others, or enforce our Terms of Use;
  • In connection with a merger, acquisition, or sale of assets, in which case your information may be transferred as part of that transaction;
  • As de-identified or aggregate data, for any purpose, since it no longer identifies you;
  • With your consent, or as otherwise described in this Policy.

We do not sell your health information.

8. Your Choices

You may:

  • Update your account information directly through the Platform;
  • Opt out of text messages as described in Section 6;
  • Adjust your browser's cookie settings, understanding that some features may not work properly as a result.

9. Data Security

We use reasonable technical and administrative safeguards to protect your information. However, no method of transmission or storage is completely secure, and we cannot guarantee absolute security. You are responsible for keeping your account credentials confidential.

10. Children's Privacy

Neshiva does not knowingly provide services to, or collect information from, anyone under 18.

11. California Resident Privacy Rights (CCPA)

If you are a California resident, the California Consumer Privacy Act (CCPA) may give you additional rights regarding certain personal information, though it does not apply to PHI governed by HIPAA or medical information governed by the California Confidentiality of Medical Information Act. For information covered by the CCPA, you may have the right to:

  • Know what personal information we've collected, used, and disclosed about you;
  • Delete personal information we've collected, subject to certain exceptions;
  • Opt out of the sale or sharing of personal information (Neshiva does not sell or share personal information with third parties);
  • Non-discrimination for exercising these rights.

We may update this Privacy Policy from time to time. The "Last updated" date above reflects the most recent revision. Continued use of the Platform after changes are posted constitutes acceptance of the updated Policy.
